A Simple Guide to Medical Malpractice and Its Many Forms

Simply speaking, medical malpractice refers to the violation of the expected standard of care, typically committed by a healthcare provider. Instances of medical malpractice aren’t only physically damaging; they can be mentally scarring too.

Improper Care After Surgery 

After experiencing surgery, it is the health professional’s duty to care for you as best as they can. If you have any infections or reactions to the anesthetic after surgery, medical staff are expected to treat you as effectively as possible. Failing to do so is considered an act of medical negligence, as postoperative care is an essential part of recovery. 

Errors in Medication Administration 

Sadly, there are many cases of bad medicine being prescribed in the United States, especially because there is such a high dependence on the use of prescription drugs. This is an error that can occur either at the physician or pharmaceutical level. Pharmaceutical brand names can be incorrectly written, or dosage levels can be higher or lower than the required amount. 

Serious Labor Complications 

Despite medical advancements, childbirth is still a very serious procedure that can result in threatening complications. It’s not just about delivering a healthy baby; you also have to monitor the mother and ensure she comes out of labor unscathed. In worst-case scenarios, birth injuries can even cause life-long issues for the child, such as cerebral palsy.  

Failure to Treat or Prevent an Infection 

Hospitals are a breeding ground for infection, therefore, if you have a patient with a weak immune system who becomes infected, you may have a serious problem on your hands. This becomes even more complicated if they are left untreated after developing an infection. The environment in a hospital must be sterile at all times. Nevertheless, infections like pneumonia, sepsis, and surgical site infections are still commonly experienced. 

Misdiagnoses or Failure to Diagnose an Illness 

There is nothing worse than being diagnosed with a serious illness months after you first reported your symptoms to a doctor. If you have a gut feeling that something is wrong and that you may have been misdiagnosed, make sure to trust your instinct. Ask for a second opinion from another doctor or to be referred to a specialist. 

Many victims of medical malpractice feel too ashamed to stand up for their rights and dispute their doctor’s claims. Unfortunately, medical malpractice can occur on all kinds of levels, to all types of people, and all across the world. 

When an error is committed in the healthcare industry, even a small mistake could be a matter of life or death. For this reason, it’s extremely important to dispute and file medical malpractice claims, as your case may help someone else in the future.
